NALEO Educational Fund Responds to Supreme Court Ruling Upholding Birthright Citizenship

The 14^th Amendment is not up for debate

WASHINGTON, D.C. — The National Association of Latino Elected and Appointed Officials (NALEO) Educational Fund released the following statement from CEO Erica Bernal-Martinez following the Supreme Court’s decision in Trump v. Barbara:

“Today, the Supreme Court has done what the Constitution demanded: reaffirmed that every child born on American soil is an American. This ruling is a victory, not just for Latino families, but for every community that believes the promise of equal citizenship is not negotiable.

“For months, parents across this country have lived with the fear that their American-born children could be rendered stateless by executive action. That fear was real — it was a direct response to a deliberate attack on the 14^th Amendment. Today’s decision makes clear that no one can rewrite more than 150 years of constitutional law through executive order.

“NALEO members have been on the frontlines of this fight — hearing directly from families in the communities they serve and pushing back against a policy that would have created two tiers of citizenship for children born in the same neighborhoods, the same hospitals, the same schools. Tonight, those families can sleep a little easier — and so can the elected officials who fought alongside them.

“This ruling is a relief, but it is not the end of the fight. The fact that birthright citizenship had to be defended at the Supreme Court in 2026 is itself a warning. NALEO Educational Fund will continue to stand guard against any effort — in the courts, in Congress, or through any other means — to undermine the constitutional rights of Latino families and all Americans. The 14^th Amendment is not up for debate.”
